This area of law has been and continues to be a very active issue in virtually all divorce cases. In 2010 when the state legislature passed “no fault” divorce, they also instituted “temporary spousal maintenance” (often called alimony). This statute was modified in 2016 when “post divorce spousal maintenance” was added to the law. In very simple terms, the calculation and the party entitled to receive spousal support is dependent on the parties income. Our office has diligently and aggressively represented parties who find themselves on either end of this issue. Because such benefit is now a mandatory calculation, this issue often takes front place in contested divorces.
