What are the assets that were accumulated during the marriage? We call these “Marital Assets”. The home, the car, the bank account, the pension, etc. A very significant issue in most/all divorces is the division of any and all marital assets. Were any of those assets “pre marital” and, idf so, be aware that there may be a claim that certain such assets may be claimed as “separate property”. As a general rule, assets accumulated during the marriage are equally divided. But, be assured, this is often a contentious issue. What’s the flip side? Marital debt! Should that also be equally divided? This is also a significant issue. Be prepared to get into the detail and controversy of equitable distribution!
